Carter's Clothing and Footwear filed a brief Thursday in the U.S. Court of Appeals for the First Circuit, arguing against a previous ruling in favor of Nike. The ruling threw out the case on the basis that Carter's had to file the suit in Nike's home state of Oregon.

"We're going to survive without Nike," said store owner Stephen Carter. "We have other shoe lines which are selling, but for the hot, collectible sneakers, the expensive ones, we are not getting any more of those. That business cannot be replaced by anything else."nike free sko danmark

The U.S. District Court ruled against Carter's on March 31, dismissing the case on the basis of Nike's "forum selection" clause.
